Terms of Service

1. Agreement

These terms are a contract between you and Pengwiz (“we”, “us”) covering your use of the Pengwiz application, API, CLI and websites (the “Service”). By creating an account or using the Service you accept them. If you accept on behalf of an organization, you confirm you have authority to bind it.

2. The Service

Pengwiz is a planning and project-management tool: strategies, bets, cycles, boards, wikis, support intake, time tracking and related features. We may improve or change features over time; we will not materially reduce the core Service you pay for during a paid term without notice.

3. Accounts

You need an account to use the Service. Keep your credentials and API keys confidential — activity under your account is your responsibility. You must be at least 16 and provide accurate account information.

4. Plans, billing and cancellation

• Individual plan: a flat monthly fee per account.
• Organization plan: a flat monthly fee plus a fee per additional member seat.
• Billing is handled by Stripe and charged monthly in advance. Seat counts sync automatically as members join or leave.
• You can cancel any time from Settings; the subscription runs until the end of the paid period. Fees already paid are non-refundable except where the law requires otherwise.

5. Your data

Everything your organization puts into the Service — bets, tasks, wiki pages, tickets, time logs, files — belongs to you. We claim no rights over it beyond what is needed to run the Service. The organization owner can export all of it as JSON at any time from Settings, and can request deletion of the organization and its data by contacting us.

6. Acceptable use

You agree not to:

• break the law, or store content you have no right to store;
• probe, overload or disrupt the Service or other customers’ data;
• resell the Service or misrepresent your affiliation with us;
• use the Service to send spam or malicious content.

We may suspend accounts that put the Service or other customers at risk.

7. AI features

Paid plans include AI-assisted features (drafting, summaries, suggestions). AI output can be wrong; review it before relying on it. Your content is sent to our AI provider only to produce the output you requested and is not used to train models.

8. Availability and support

We aim to keep the Service available around the clock but do not guarantee uninterrupted operation. Support is provided by email at hello@pengwiz.com.

9. Disclaimers and liability

The Service is provided “as is”. To the maximum extent the law allows, we disclaim implied warranties and our total liability for any claim is limited to the fees you paid us in the twelve months before the event giving rise to it. Neither party is liable for indirect or consequential damages.

10. Termination

You may stop using the Service and delete your account at any time. We may terminate for material breach of these terms if the breach is not cured within 14 days of notice. On termination we make your data available for export for 30 days, then delete it.

11. Changes to these terms

We may update these terms; material changes will be announced in the app or by email at least 14 days before they take effect. Continuing to use the Service after that means you accept the new terms.
